Terms and Conditions
These Terms and Conditions govern your access to and use of the Hestejarin online store, including browsing products, placing orders, making payments, requesting cancellations, and contacting customer service. Please review these terms carefully before making a purchase.
1. Introduction and Scope
Welcome to Hestejarin (“Hestejarin,” “we,” “us,” or “our”). These Terms and Conditions apply to your use of our online store and purchases made through our website.
I. Acceptance of Terms. By accessing or using our website, you agree to these Terms and Conditions to the extent permitted by applicable law. Placing an order also indicates your agreement to the terms presented during checkout. If you do not agree, please discontinue use of the website.
II. Related Policies. These Terms and Conditions should be read together with our Shipping Policy, Return and Refund Policy, Cancellation Policy, Payment Policy, Privacy Policy, and Cookie Policy. Each policy provides additional information about its specific subject. If provisions in our policies appear inconsistent, we will interpret them consistently where reasonably possible. These Terms and Conditions establish the general framework governing use of our website and purchases, while each specific policy provides additional details about the subject it addresses. Any express commitment made to the customer at the time of sale and any mandatory consumer right will remain effective. No policy will be interpreted to exclude, restrict, or reduce a right or remedy that applicable law does not permit us to waive or limit.
III. Business Information. Hestejarin operates an online store using the contact information provided in Section 14. Our business address is in Japan. Customers should review the product listing, checkout information, and applicable shipping terms to understand the transaction and delivery arrangements before purchasing.
2. Website Use and Customer Responsibilities
I. Accurate Information. You agree to provide accurate, complete, and current information when placing an order or contacting us, including your name, email address, telephone number, billing details, and shipping address. We are not responsible for delivery problems caused by incorrect information supplied by a customer, except where applicable law provides otherwise.
II. Account Security. If account registration is available, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. Please notify us promptly if you suspect unauthorized access.
III. Prohibited Conduct. You must not use our website for fraudulent transactions, unauthorized access, unlawful activity, interference with website operations, distribution of malicious code, or submission of misleading information. We may take proportionate measures to protect our customers, systems, transactions, and legal interests, subject to applicable law.
IV. Website Availability. We make reasonable efforts to maintain website functionality and accurate content. However, we do not guarantee uninterrupted or error-free access. Maintenance, technical problems, network interruptions, security incidents, and other circumstances may temporarily affect availability.
3. Products, Product Information, and Pricing
I. Product Descriptions. We make reasonable efforts to describe products accurately, including their materials, specifications, dimensions, features, and intended uses where relevant. Product images are illustrative and should be considered together with the written description. Display settings may cause minor visual differences, but this does not remove any applicable rights relating to a materially misdescribed or defective product.
II. Availability. Products are offered subject to availability. If a product becomes unavailable after an order is submitted, we will notify you and explain the available options. Where we cannot fulfill an order, we will provide the applicable cancellation and refund options.
III. Prices and Charges. The price, shipping charge, applicable taxes, and other mandatory charges known to us will be disclosed during checkout before you submit payment. Unless expressly stated otherwise, the order total shown at checkout is the amount you authorize us to charge. We may change prices for future purchases, but a price change will not retroactively alter an accepted order without an appropriate legal basis and, where required, your agreement.
IV. Errors and Corrections. If we discover a material pricing, product listing, or availability error before accepting or fulfilling an order, we may contact you to explain the issue and offer reasonable options, including cancellation and a refund where appropriate. We will not knowingly substitute a materially different product without your agreement.
V. Product Compliance. Products will be supplied in accordance with their applicable descriptions and the express commitments made at the time of sale, subject to mandatory law. Nothing in this section limits rights or remedies available for defective, unsafe, misdescribed, or nonconforming products.
4. Orders and Payment
I. Order Submission and Acceptance. Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt but does not necessarily establish that every verification and fulfillment step is complete. We will communicate any material issue affecting acceptance or fulfillment.
II. Order Review. We may review orders for payment authorization, product availability, accuracy of information, suspected fraud, or technical errors. If we cannot accept or fulfill an order, we will notify you within a reasonable period and arrange any refund required by law or our stated policies.
III. Accepted Payment Methods. We accept American Express, Discover, JCB, Mastercard, and Visa, subject to availability at checkout. Payment must be successfully authorized before an order proceeds to fulfillment. Your payment may also be subject to the applicable payment provider's terms.
IV. Order Verification. Before completing checkout, please verify the selected products, quantities, shipping address, delivery options, shipping fees, applicable taxes, and final order total. Contact us promptly if you notice an incorrect charge, duplicate transaction, or other payment issue.
V. Refund Destination. Approved refunds will ordinarily be issued to the original payment method. If that method cannot reasonably be used, we will work with you to identify a lawful and appropriate alternative. We will not require you to waive a mandatory refund right to receive a refund.
For more information, please review our Payment Policy.
5. Shipping, Processing, and Delivery
I. Order Processing. Our standard order processing time is 1–3 business days after a properly completed order has been received and payment has been authorized, unless a different timeframe is clearly disclosed before purchase.
II. Transit Estimates. The estimated transit time after dispatch is 5–8 business days. Based on these estimates, the expected total delivery timeframe is approximately 6–11 business days, consisting of processing and transit time. These are estimates rather than guaranteed arrival dates, and we will not advertise or represent a delivery timeframe without a reasonable basis for expecting to meet it.
III. Shipping Charges. Orders with a product subtotal of $99.00 or more qualify for free standard shipping. Orders with a product subtotal below $99.00 are charged a standard shipping fee of $8.90. Any applicable exclusions or additional charges must be disclosed before checkout. The product subtotal is calculated before shipping charges and applicable taxes unless the checkout clearly states otherwise.
IV. Delivery Delays. Delays may result from carrier operations, severe weather, customs processing, incorrect addresses, or other circumstances. If we cannot ship within the timeframe represented at purchase, we will provide the delay notice and cancellation or refund options required by applicable law, including the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule where applicable. We will not treat silence as consent to a delay where the law requires affirmative consent.
V. Delivery Issues. If an order is missing, materially delayed, damaged in transit, or delivered incorrectly, contact us promptly with your order number and relevant evidence. We will review the issue and explain the available resolution. Nothing in this section makes the customer responsible for a loss that applicable law assigns to the seller or carrier.
Please read our Shipping Policy for additional information about dispatch, tracking, delivery estimates, and shipping inquiries.
6. Order Cancellation
I. Cancellation Request Period. You may request cancellation within 48 hours after placing an order, provided that the order has not been shipped. The 48-hour period begins at the time the order is submitted, as recorded in our order system. A cancellation request is not guaranteed to succeed merely because it is submitted within this period; the order must still be unshipped and the request must be processed before dispatch.
II. Orders Already Shipped. Once an order has been shipped, cancellation under this voluntary 48-hour procedure is generally unavailable. You may instead request a return in accordance with our Return and Refund Policy, subject to applicable law. This restriction does not remove any statutory cancellation, rejection, or refund rights that may apply. The unavailability of cancellation under this voluntary procedure does not affect any statutory right to cancel, reject delivery, return goods, or obtain a refund that applies under applicable law, or any remedy expressly provided under our other applicable policies.
III. How to Request Cancellation. Email assist@hestejarin.com with your order number and a clear cancellation request. Do not send full payment card numbers, security codes, or other unnecessary sensitive financial information by email. We will confirm whether cancellation can be completed.
IV. Cancellation Refunds. If cancellation is approved, we will initiate the applicable refund to the original payment method within 1–3 business days after approval, unless a shorter period is required by law. Your card issuer or financial institution may require additional time to post the credit. Where applicable law requires a faster refund, that legal deadline controls.
V. Seller-Initiated Cancellation. If we cancel an order because of unavailability, a material listing error, inability to ship, or another valid reason, we will explain the situation and provide any refund required by law. A voluntary cancellation window does not limit a consumer's right to cancel an unshipped order or obtain a refund when required by applicable law.
For full instructions, see our Cancellation Policy.
7. Returns, Exchanges, and Return Shipping
I. Standard Return Notification Period. For our voluntary commercial return program, you must notify us of your return or exchange request within 35 calendar days after the product is delivered to the shipping address provided with the order. The period begins on the delivery date shown by the carrier's tracking record or other reliable delivery evidence. If an order arrives in separate shipments, the period for each product begins when that product is delivered. This 35-day period applies to our voluntary commercial return program and does not limit any statutory warranty, conformity claim, defect-related remedy, or other consumer right available under applicable law. A request made after this period may still qualify for repair, replacement, refund, price reduction, or another remedy where required by law or expressly provided under our applicable product warranty.
II. Return Shipment Deadline. After we approve a return and send the return authorization notice and instructions, you must dispatch the product to the designated return address within 14 calendar days after the approval notice is sent, unless we confirm a different period in writing or applicable law requires otherwise. The return is considered dispatched when it is handed to the carrier. You should retain the tracking number and proof of shipment. If you cannot meet this deadline for a reasonable reason, contact us before it expires. We will consider an appropriate extension where reasonable or required by law.
III. Eligible Reasons. Return requests may be submitted for defective or damaged products, significant discrepancies between the delivered product and its description, incorrect items, significant undisclosed differences in material characteristics, or a change of mind. Eligibility, available remedies, and any necessary inspection will be assessed fairly under this policy and applicable law. A change-of-mind return is a voluntary commercial option and may be subject to reasonable conditions disclosed here.
IV. Condition and Evidence. Where reasonably necessary, we may request the order number, proof of purchase, a description of the issue, and clear photographs or videos showing the relevant damage, defect, or discrepancy. Please do not send a product back before receiving return instructions. We will not use an evidence request to unreasonably delay or deny a valid claim.Return authorization is intended to facilitate identification and processing of the returned product. Failure to obtain authorization in advance will not automatically eliminate a consumer's statutory rights or a remedy required by applicable law. Where reasonably possible, contact us before shipping so that we can provide the correct return instructions and help avoid unnecessary shipping costs or delays.
V. Return Shipping Costs. For a change-of-mind return, the customer is responsible for the reasonable cost of return shipping, provided that this responsibility was disclosed before purchase and is permitted by applicable law. For a defective, damaged, incorrect, or materially misdescribed product, we will provide the remedy and return-shipping arrangements required by applicable law and our applicable product commitments. Where we are responsible for return shipping, we will explain whether we will provide a prepaid label, arrange collection, or reimburse reasonable authorized costs.
VI. Large or Bulky Items. Before purchase, customers should be able to review a reasonable estimate of the cost of returning large or bulky products. Depending on the product's size, weight, packaging, destination, carrier, and collection requirements, the estimated return shipping cost may be approximately $10.00–$25.00 or more. This is an estimate, not a fixed charge or a guarantee that every return will fall within that range.Where an authorized return must be shipped internationally, including to Japan, actual return shipping costs may exceed this estimate. Where a materially higher cost is reasonably foreseeable, we will disclose a more accurate estimate before purchase whenever reasonably practicable. Customers should contact us for a product-specific estimate before shipping a large or bulky item. Any return shipping charge will be subject to the applicable policy and law, and we will not impose a charge that is not lawfully permitted.
VII. Product Handling. Please return products with reasonable care and, where practicable, include the original accessories, components, and packaging. A reduction in value caused by handling beyond what is reasonably necessary to inspect the product may be considered only to the extent permitted by applicable law. Original packaging will not be required where such a requirement would unlawfully restrict a consumer's rights. For discretionary change-of-mind returns, the product should be unused and in its original condition, with its original packaging and included accessories where reasonably available and applicable. These conditions do not automatically apply to defective, damaged, misdescribed, or otherwise nonconforming products where applicable law provides a remedy.
VIII. Exchanges. Exchanges are subject to product availability and inspection where relevant. For an approved commercial exchange, we generally expect to dispatch an available replacement within 1–3 business days after any reasonably necessary inspection has been completed and the replacement's availability has been confirmed. Business days exclude Saturdays, Sundays, and applicable public holidays. If the requested replacement is unavailable, we will discuss an appropriate alternative, repair, refund, or other remedy as required by applicable law.
For the complete process, please consult our Return and Refund Policy.
8. Refund Eligibility, Method, and Processing Time
I. Refund Eligibility. A refund may be available following an approved cancellation, an eligible return, a product defect or material misdescription, failure to fulfill an order, or another circumstance in which a refund is required by applicable law or expressly provided under our policies. We will not deny a legally required refund solely because a voluntary return condition has not been met.
II. Refund Initiation. For an approved voluntary return, we will generally initiate the refund within 1–3 business days after we receive the returned product and complete any reasonable inspection required to assess the claim. For an approved cancellation or a seller-initiated refund that does not require a return, we will generally initiate the refund within 1–3 business days after approval. These internal processing targets do not extend a shorter statutory refund deadline.
III. Refund Method. Refunds will ordinarily be returned to the original American Express, Discover, JCB, Mastercard, or Visa payment method used for the purchase. If the original payment method is unavailable, we will explain the available lawful alternative rather than indefinitely withholding a refund that is due.
IV. Posting Time. After we initiate a refund, we expect the credit to appear within 1–3 business days in many cases. This is an estimate only. The actual posting time depends on the card issuer, payment processor, and financial institution and may take longer. The time required by a third party to post a credit is separate from our obligation to initiate the refund within the applicable deadline.
V. Refund Amount. The refund amount will be determined by the circumstances of the transaction, the charges paid, the applicable policy, and applicable law. Where an order cannot be shipped and the law requires a full refund, the refund will include the amounts required by law, including applicable shipping or handling charges. Any deduction for return shipping or a reduction in value will be applied only when authorized by the disclosed policy and applicable law.
VI. Refund Confirmation. We will provide reasonable confirmation when a refund is initiated. If the credit has not appeared after the estimated posting period, contact assist@hestejarin.com with your order number so we can review the transaction and, where available, provide relevant refund information.
Please also review our Return and Refund Policy and Payment Policy.
9. New Product Conformity Commitment and Remedies
I. Two-Year Commercial Conformity Commitment. For new products sold by Hestejarin, we provide a commercial conformity commitment lasting two years from the date the product is delivered to the customer. This commitment is intended to address a product's failure to conform materially to its description, agreed specifications, or expressly stated functionality at the time of sale, subject to the conditions below. It is a Hestejarin commercial commitment and must not be interpreted as a statement that United States federal law imposes a universal two-year statutory warranty on every consumer product. Any longer or otherwise mandatory rights under applicable law remain unaffected. The detailed claim procedures, evidence requirements, and return arrangements for this commercial commitment are described in our Return and Refund Policy. Any product-specific warranty terms may supplement or clarify the coverage applicable to a product but will not reduce any express commitment made at the time of sale or any consumer right that cannot lawfully be excluded or restricted. If these policies appear inconsistent regarding the scope of this commercial commitment, they will be interpreted consistently where reasonably possible without reducing any such commitment or mandatory consumer right.
II. Covered Issues. During the commitment period, a customer may contact us regarding a qualifying manufacturing defect, material nonconformity, or failure to perform an expressly stated product function under normal intended use. We may request reasonable proof of purchase, a description of the issue, and photographs, videos, or other evidence reasonably necessary to evaluate the claim.
III. Free Repair or Replacement. Where a claim is covered, Hestejarin will provide repair or replacement without charge for the covered remedy, including reasonable parts, labor, and necessary shipping costs associated with providing that remedy. We will explain the proposed remedy and any required shipping arrangements before the customer sends the product. If a covered defect cannot reasonably be repaired, a replacement is unavailable, a repair or replacement fails, or we do not provide the remedy within a reasonable time, we will offer an appropriate further remedy, which may include a refund or price reduction where appropriate and permitted by law. All remedies remain subject to applicable law, and no provision of this commitment will reduce a consumer's mandatory legal rights.
IV. Conditions and Exclusions. To the extent permitted by applicable law, this commercial warranty does not cover damage caused solely by misuse, neglect, accidental damage occurring after delivery, unauthorized modification, improper installation contrary to supplied instructions, failure to follow applicable care instructions, or ordinary wear and tear. An exclusion will not apply where the reported issue results from a covered defect, a misleading product representation, or another circumstance for which Hestejarin is responsible under applicable law. We will assess the circumstances reasonably and will not rely on an exclusion without a reasonable basis for concluding that it applies.
V. Further Remedies. If a covered defect cannot reasonably be repaired, a replacement is unavailable, a repair or replacement fails, or we do not provide the remedy within a reasonable time, we will offer an appropriate further remedy, which may include a refund or price reduction where appropriate and permitted by law. Where applicable law provides a right to reject the product, rescind the transaction, or obtain another remedy, that right remains available regardless of this commercial commitment.
VI. Statutory Rights. The commitment in this section supplements, and does not replace, any applicable express or implied warranties, statutory guarantees, product safety protections, or other mandatory consumer rights. The duration and scope of any legal warranty or conformity obligation depend on the law applicable to the transaction and product. Nothing in this section waives rights that cannot lawfully be waived.
VII. How to Make a Claim. Email assist@hestejarin.com with your order number, the product name, a description of the issue, and supporting evidence where reasonably available. We will review the claim and provide instructions for repair, replacement, return, or another appropriate remedy.
10. Disputes and Governing Law
I. Customer Support First. If you have a concern about a product, payment, shipment, cancellation, return, refund, or other transaction, please contact us first with your order number and a description of the issue. We will review the available information and make reasonable efforts to resolve the matter fairly.
II. Applicable Law. These Terms and Conditions are subject to applicable United States federal law and the state laws that apply to the transaction, including any mandatory consumer protections. The fact that Hestejarin's listed business address is in Japan does not eliminate any consumer rights or legal obligations that apply to a transaction with a United States customer.
III. No Unlawful Waiver. Nothing in these Terms and Conditions requires a customer to waive a non-waivable right, restricts a remedy that must remain available by law, or prevents a customer from contacting a relevant consumer protection authority. Any dispute resolution procedure must be applied consistently with applicable law.
IV. Resolution and Remedies. We encourage customers to provide sufficient information for us to investigate a dispute. Depending on the circumstances, an appropriate resolution may include clarification, correction, replacement, repair, cancellation, refund, or another remedy required by law.
11. Privacy and Data Protection
I. Information We Handle. When you browse our website, place an order, make a payment, or contact customer service, we may process contact details, shipping information, order history, payment-related records, device or usage information, and communications you provide.
II. Purposes of Processing. We use relevant information to process and fulfill orders, arrange shipping, provide support, prevent fraud, maintain records, secure our website, comply with legal obligations, and perform other purposes disclosed in our Privacy Policy.
III. Service Providers. Information may be disclosed to payment processors, shipping providers, website hosting providers, analytics services, customer support platforms, and other service providers where reasonably necessary for business operations, subject to applicable legal requirements and appropriate safeguards.
IV. Privacy Choices. Depending on applicable law, customers may have rights to request access to, correction of, or deletion of certain personal information, or to opt out of certain data processing activities. The availability and scope of these rights depend on the applicable law and the circumstances.
V. Additional Information. Our Privacy Policy explains our information practices, while our Cookie Policy explains cookies and similar technologies. Please review both policies for additional details.
12. Intellectual Property and User Content
I. Website Materials. Unless otherwise indicated, website text, product descriptions, photographs, graphics, logos, page layouts, and other content are owned by Hestejarin or used with appropriate authorization.
II. Permitted Use. You may browse the website and use its content for personal, non-commercial shopping purposes. Except where applicable law permits otherwise, you may not reproduce, distribute, modify, publish, or commercially exploit website content without prior written authorization.
III. Third-Party Rights. Nothing in these Terms and Conditions grants you ownership of Hestejarin's intellectual property or the intellectual property of a third party. We respect intellectual property rights and may review properly submitted infringement notices in accordance with applicable law.
IV. Customer Submissions. If you submit reviews, photographs, feedback, or other content, you must have the necessary rights to provide that content. Any license or permission associated with such submissions will be limited to the rights disclosed at the time of submission and subject to applicable law and our Privacy Policy.
13. Limitation of Liability and Changes to These Terms
I. Permitted Limitations. To the extent permitted by applicable law, Hestejarin will not be liable for indirect, incidental, special, consequential, or punitive losses arising from website use or temporary unavailability, except where such limitation is prohibited by law or the loss results from liability that cannot lawfully be excluded.
II. Non-Excludable Liability. Nothing in these Terms and Conditions excludes or limits liability for fraud, intentional misconduct, or any other matter for which exclusion or limitation is prohibited by applicable law. Nothing limits mandatory consumer remedies for defective or misdescribed products, failure to fulfill an order, or other protected rights.
III. Reasonable Website Operations. We make reasonable efforts to maintain website availability, accurate product information, and reliable order processing. However, we cannot guarantee that the website will always be free from errors, interruptions, or technical problems.
IV. Changes to Terms. We may revise these Terms and Conditions to reflect changes in our operations, products, procedures, or legal requirements. Updated terms will be published on this page. Where a change materially affects customers, we will provide appropriate notice when required or reasonably necessary. Changes will apply prospectively unless a different application is permitted by law and properly disclosed. A revision will not retroactively remove a customer's accrued rights or alter an existing order in a manner prohibited by law.
V. Severability. If any provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. The invalid provision will be interpreted or limited only as necessary to comply with applicable law.
VI. Entire Agreement and Policy References. These Terms and Conditions and the policies expressly referenced in them describe the terms governing the relevant website and transaction, subject to applicable law and any additional terms clearly presented and accepted at checkout.
